3. General and Mandatory Information

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy. When you use this website, various personal data are collected. Personal data is data with which you can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done. We point out that data transmission over the Internet (e.g., when communicating by email) can have security gaps. A complete protection of data against access by third parties is not possible.

The controller for data processing on this website is: Engin Murat Otto-Röhm-Str. 38 64293 Darmstadt Telephone: 015752763406 Email: info@chessonyx.com The controller is the natural or legal person who alone or jointly with others decides on the purposes and means of the processing of personal data (e.g., names, email addresses, etc.).

Storage Duration

Unless a more specific storage period has been specified within this privacy policy, your personal data will remain with us until the purpose for data processing no longer applies. If you assert a legitimate request for erasure or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g., tax or commercial law retention periods); in the latter case, the erasure takes place after these reasons no longer apply.

General Information on the Legal Bases for Data Processing on This Website

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, insofar as special categories of data according to Art. 9(1) GDPR are processed. In the event of express consent to the transfer of personal data to third countries, data processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or to access to information in your end device (e.g., via device fingerprinting), the data processing is additionally based on § 25(1) TDDDG. Consent can be revoked at any time. If your data is required for contract fulfillment or to carry out pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data if it is necessary to fulfill a legal obligation on the basis of Art. 6(1)(c) GDPR. Data processing can also take place on the basis of our legitimate interest according to Art. 6(1)(f) GDPR. Information about the legal bases applicable in each individual case is provided in the following paragraphs of this privacy policy.

Recipients of Personal Data

As part of our business activities, we work with various external bodies. In some cases, a transfer of personal data to these external bodies is also necessary. We only pass on personal data to external bodies if this is necessary as part of fulfilling a contract, if we are legally obliged to do so (e.g., passing on data to tax authorities), if we have a legitimate interest according to Art. 6(1)(f) GDPR in passing it on, or if another legal basis allows the data transfer. When using processors, we only pass on personal data of our customers on the basis of a valid contract for data processing. In the case of joint processing, a contract for joint processing is concluded.

Revocation of Your Consent to Data Processing

Many data processing operations are only possible with your express consent. You can revoke a consent already given at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to Object to Data Collection in Special Cases and to Direct Advertising (Art. 21 GDPR)

IF THE DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN PROVE COMPELLING LEGITIMATE REASONS FOR THE PROCESSING WHICH OUTWEIGH YOUR INTERESTS, RIGHTS, AND FREEDOMS OR THE PROCESSING SERVES TO ASSERT, EXERCISE, OR DEFEND LEGAL CLAIMS (OBJECTION ACCORDING TO ART. 21(1) GDPR). IF YOUR PERSONAL DATA IS PROCESSED TO OPERATE DIRECT ADVERTISING, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH ADVERTISING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS ASSOCIATED WITH SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT ADVERTISING (OBJECTION ACCORDING TO ART. 21(2) GDPR).

Right of Appeal to the Competent Supervisory Authority

In the event of violations of the GDPR, those affected have a right of appeal to a supervisory authority, in particular in the Member State of their habitual residence, their place of work, or the place of the alleged violation. The right of appeal exists without prejudice to other administrative or judicial remedies.

Right to Data Portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. Insofar as you demand the direct transfer of the data to another controller, this will only take place insofar as it is technically feasible.

Access, Rectification, and Erasure

Within the framework of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipient, and the purpose of the data processing and, if applicable, a right to rectification or erasure of this data. You can contact us at any time regarding this and other questions on the subject of personal data.

Right to Restriction of Processing

You have the right to demand the restriction of the processing of your personal data. You can contact us at any time regarding this. The right to restriction of processing exists in the following cases: If you contest the accuracy of your personal data stored by us, we usually need time to check this. For the duration of the check, you have the right to demand the restriction of the processing of your personal data. If the processing of your personal data happened/is happening unlawfully, you can demand the restriction of data processing instead of erasure. If we no longer need your personal data, but you need it to exercise, defend, or assert legal claims, you have the right to demand the restriction of processing instead of erasure. If you have filed an objection according to Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it is not yet certain whose interests prevail, you have the right to demand the restriction of the processing of your personal data. If you have restricted the processing of your personal data, this data — apart from its storage — may only be processed with your consent or to assert, exercise, or defend legal claims or to protect the rights of another natural or legal person or for reasons of an important public interest of the European Union or a Member State.

SSL or TLS Encryption

You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to Advertising Emails

The use of contact data published as part of the imprint obligation for the purpose of sending advertising and information materials not expressly requested is hereby prohibited. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam emails.

4. Data Collection on This Website

Cookies

Our internet pages use so-called "cookies." Cookies are small data packets and do not cause any damage to your end device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted after the end of your visit. Permanent cookies remain stored on your end device until you delete them yourself or an automatic erasure by your web browser takes place. Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g., cookies to process payment services). Cookies have various functions. Numerous cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies can be used to evaluate user behavior or for advertising purposes. Cookies that are required to carry out the electronic communication process, to provide certain functions you desire (e.g., for the shopping cart function), or to optimize the website (e.g., cookies to measure the web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. Insofar as consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG); the consent can be revoked at any time. You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or generally, and activate the automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of this website may be restricted.

Cookie Consent Tool (Usercentrics / Cookiebot)

This website uses a tool to obtain and manage your consents (consent management), e.g., Usercentrics or Cookiebot. With the help of this tool, consents for the storage of certain cookies as well as for the use of certain technologies are obtained and documented. In this context, the following data in particular can be processed: consent status, time of consent, IP address (shortened if necessary), browser, and device information. The legal basis for using the consent management tool is Art. 6(1)(c) GDPR (legal obligation) as well as § 25(1) TDDDG, insofar as consent is required.

Server Log Files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are: Browser type and browser version, Operating system used, Referrer URL, Host name of the accessing computer, Time of the server request, IP address. A combination of this data with other data sources is not performed. The collection of this data is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free display and optimization of its website — for this purpose, the server log files must be recorded.

This website uses Vercel Web Analytics to analyze visitor traffic. The provider is Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, USA. Vercel Web Analytics is designed to be privacy-friendly; it does not use cookies and does not collect personally identifiable information (PII). The processing is based on our legitimate interest in the optimization of our website (Art. 6(1)(f) GDPR).

Inquiry via Email, Telephone, or Fax

If you contact us via email, telephone, or fax, your inquiry including all personal data resulting from it (name, inquiry) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent. The processing of this data is based on Art. 6(1)(b) GDPR, insofar as your inquiry is related to the fulfillment of a contract or is necessary to carry out pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) insofar as this has been requested; the consent can be revoked at any time. The data sent to us by you via contact inquiries will remain with us until you ask us for erasure, revoke your consent for storage, or the purpose for data storage no longer applies (e.g., after the processing of your request has been completed). Mandatory statutory provisions — in particular statutory retention periods — remain unaffected.

Registration on This Website

You can register on this website to use additional functions. We use the data entered for this purpose only for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will refuse the registration. To process the registration and to prevent abuse, we store the IP address used at the time of registration as well as the time of registration. The processing of the data entered during registration takes place for the purpose of carrying out the user relationship established by the registration and, if necessary, to initiate further contracts (Art. 6(1)(b) GDPR). The use of this service is based solely on your consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG). The consent can be revoked at any time. We use Google Analytics with IP anonymization. This means that your IP address is shortened by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area before being transmitted to the USA.

Google Ads

This website uses Google Ads. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Ads enables us to display advertisements in the Google search engine or on third-party websites when the user enters certain search terms at Google (keyword targeting). The use of this service is based solely on your consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG). The consent can be revoked at any time.

Google Conversion Tracking

As part of Google Ads, we use so-called conversion tracking. When you click on an ad placed by Google, a cookie is set for conversion tracking. These cookies lose their validity after 30 days and do not serve the personal identification of users. Every Google Ads customer receives a different cookie. The cookies cannot be tracked via the websites of Google Ads customers. The information obtained with the help of the conversion cookie serves to create conversion statistics. We learn the total number of users who clicked on our ad and were redirected to a page tagged with a conversion tracking tag. The use of this service is based solely on your consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG). The consent can be revoked at any time.

The use of this service is based solely on your consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG). The consent can be revoked at any time.

We collect, process, and use personal data only insofar as they are necessary for the establishment, content-related design, or amendment of the legal relationship (inventory data). This takes place on the basis of Art. 6(1)(b) GDPR (processing for the fulfillment of a contract or pre-contractual measures).
